LEGAL DISCLAIMER: This document constitutes a master "Extended Service, Maintenance, and Buyback Contract" between the Customer and Moment Care (hereinafter "The Company"). This document is strictly NOT an Insurance Policy. It is a contractual commitment to repair, replace, or provide guaranteed trade-in valuations as per the absolute and strict terms stated herein.
1. Definitions & Interpretations
"Company" refers exclusively to Moment Care and its directly authorized administrative entities.
"Customer" refers to the individual or entity whose name is registered and authenticated on the official Moment Care+ Certificate.
"Covered Device" refers to the specific smartphone strictly mapped to the 15-digit IMEI number securely logged in the Company's centralized servers. Only this singular IMEI is recognized for benefits.
"AutoPay / E-Mandate" refers to the automated, irrevocable monthly deduction protocol authorized by the Customer via UPI or Credit/Debit Card for electronic installments (EMI).
2. Scope of Contractual Coverage
A. Extended Warranty (EW)
The Extended Warranty (EW) module commences exactly upon the expiration of the original Manufacturer’s Warranty. It strictly covers the cost of original parts and labor required for repairing structural, mechanical, and electrical breakdowns (e.g., Motherboard failure, speaker/mic defects, display blackout without physical impact) that occur during normal, non-abusive usage.
B. Accidental & Liquid Damage Protection (ADLD)
If the ADLD module is purchased, coverage commences on the Invoice Date (or after the stipulated digital waiting period, if any). It protects against accidental drops resulting in fractured displays or structural failures affecting internal functionality, as well as accidental liquid submersion that triggers the internal Liquid Damage Indicator (LDI).
3. Strict General Exclusions & Void Actions
The Company shall hold zero liability to repair, replace, or compensate for the Covered Device under the following absolute conditions:
- EW Restriction (No Physical/Liquid Damage): The Extended Warranty (EW) plan is strictly limited to inherent manufacturing defects and internal mechanical/electrical failures. Any presence of accidental physical damage (cracks, heavy dents, bends) or liquid damage (triggered LDI, internal corrosion) instantly and permanently VOIDS the Extended Warranty contract.
- Intentional Damage & Fraud: Intentionally breaking, dropping, submerging, or destroying the device to claim a replacement, free repair, or total loss is strictly prohibited. If the Company’s technical panel determines the damage is intentional or staged, the contract will be immediately terminated without a refund, and the Customer will be permanently blacklisted.
- Unauthorized Repair: If the device has been opened, serviced, modified, or handled by any third-party mechanic, local shop, or unauthorized service center, this contract is permanently voided.
- Folding Devices & Experimental Tech: Inner foldable displays (e.g., Galaxy Fold, Flip series) are strictly excluded from extended screen replacements unless explicitly stated otherwise in a specialized "Fold+" addendum.
- Accessories & Consumables: Batteries, chargers, cables, stylus pens, cases, and general cosmetic wear & tear (scratches, scuffs, or peeling paint that do not affect functionality) are entirely excluded.
- Theft or Loss: If the device is lost, stolen, or misplaced, it falls entirely outside the scope of this contract.
- Software & Data Loss: The Company assumes no responsibility for any loss of personal data, photos, or software corruption during the diagnostic or repair process. The Customer is solely responsible for securely backing up and wiping their device prior to handover.
4. Claim Initiation & Mandatory Processing Fees
To initiate a claim, the Customer must present the device at a designated Moment Care Service Center along with the Digital Contract ID and Original Purchase Invoice. To prevent frivolous requests and cover initial logistics, the following mandatory, non-refundable Diagnostic & Processing Fees apply. This fee must be paid before any diagnostic work commences:

5. Beyond Economic Repair (BER) & Depreciation Matrix
If the technical cost to repair the Covered Device exceeds the current market depreciated value of the device, or if original spare parts are permanently rendered unavailable by the original manufacturer, the Company reserves the absolute right to declare the device as "Beyond Economic Repair" (BER).
In the event of BER, the Company will not proceed with the repair. Instead, the Company will issue a Moment Care Store Gift Voucher equivalent to the calculated depreciated value of the device. This voucher can be redeemed strictly against the purchase of a new device at any authorized Moment Care retail partner. Issuance of this voucher fully, finally, and permanently discharges the Company from any further contractual obligations.

6. No-Claim Bonus (NCB) & Guaranteed Trade-In Engine
The Company aggressively rewards careful users through the Moment Care Trade-In Engine. If a Customer completes their designated plan tenure without filing a single claim, they unlock a guaranteed Trade-In Upgrade Bonus.
- Eligibility Protocol: The plan must be Active, have zero (0) claims filed in its lifetime database history, and all EMI dues (if applicable) must be fully cleared.
- Valuation Math: The Trade-In value is algorithmically calculated based on a proprietary Brand Depreciation Matrix (e.g., Apple devices historically retain higher percentages than standard Android devices).
- Live Recalculation Engine: The percentage offered during the digital "Application" phase is a provisional estimate. The final payable percentage is calculated by the Company's servers strictly on the exact day the device is physically presented in the store. If a customer applies at Month 10 but visits the store at Month 16, the system will irrevocably apply Month 16 depreciation rules to protect corporate margins.
- Physical Condition Audit: The device must power on normally, have no physical/liquid damage, possess a flawless display, and be logged out of all iCloud/Google security accounts. Failure to meet these criteria gives the Store Admin absolute authority to reject the Trade-In request or downgrade it to a standard valuation.
- Voucher Execution: Upon final store approval, the Moment Care+ plan is permanently terminated, and a Store Credit Voucher is issued toward a new hardware purchase.
7. EMI, AutoPay & E-Mandate Strict Rules
If the Customer opts to purchase the Moment Care+ Plan via monthly EMI, they are legally authorizing an e-Mandate / AutoPay via UPI or Card. By selecting this option, the Customer is legally bound by the following conditions:
1. Irrevocable Deduction: The specified EMI amount will be automatically deducted from the linked bank account on the scheduled due date every month until the total plan value is recovered.
2. Bounce Penalties & Freezing: If an AutoPay mandate bounces due to insufficient funds, the plan enters a restricted "Grace Period." If the pending cash is not collected manually at an authorized store within this period, all coverage, claim rights, and No-Claim Bonuses are instantly and permanently frozen.
3. Absolute Claim Lock: No claims, repairs, or Trade-In requests will be processed if there is a pending, bounced, or uncleared EMI installment on the ledger.
4. Foreclosure Rights: Customers may visit an authorized Moment Care store to foreclose the loan by paying the remaining balance in full via cash or UPI. Upon successful foreclosure, the Company will initiate the cancellation of the AutoPay mandate.
8. Device Security Lock & Cancellation Policy
1 IMEI = 1 Plan Rule: The Company’s servers enforce a strict cryptographic "One IMEI, One Lifetime Plan" security protocol. Once an IMEI is registered to a Moment Care+ plan, it is locked. It cannot be registered for a secondary, overlapping, or extended plan under any circumstances in the future.
Strictly Non-Refundable: Due to the immediate assumption of financial risk by the Company upon digital activation, this Service Contract is completely non-refundable. It cannot be cancelled for cash. The coverage remains cryptographically attached to the IMEI, meaning if the device is sold privately, the new owner inherits the remaining coverage automatically.
9. Governing Law, Arbitration & Jurisdiction
This Contract shall be governed by, construed, and enforced in accordance with the laws of India. Any disputes, controversies, or claims arising out of or in connection with this Service Contract, including its validity, interpretation, or termination, shall be subject to the exclusive jurisdiction of the competent courts located in Siliguri, West Bengal, India.
